Part 1: Morning: Overview of Conservation Easements on Land: Property Rights in Use, Occupancy, Access, and Control That Affect Value

 

·         Use Rights, Control Rights- legal development potential, land disturbance rights

Existing structures and permitted additional structures; Holder of Easement rights

·         Access and Occupancy Rights- will there be Life Estate rights retained, or a public access trail?

·         Permanent Easement or Expires after Specific Time Period?

Part 2: Morning: Specific Conservation Easement Issues that Vary for Individual Properties

 

·         Severable vs. Non-Severable rights for future lot areas

·         Effect of Easements on Access to Conserved and Excepted areas; is remaining access over wetland?

·         Overview of IRS Tax Credit Rules for Conservation Easements

·         Local Examples of Conservation Easement properties

·         Are other uses permitted on Conserved farms, such as winery, solar farms, solar canopies, events/weddings?

 

Part 3: Afternoon: Overview of Permanent and Temporary Historic Easements: Designation of Historic Properties, SHPOs and National Trust for Historic Preservation; NY Case Study Examples

THIS CLASS WILL BE HELD VIA VIRTUAL INTERACTIVE CLASSROOM TECHNOLOGY. STUDENTS ARE REQUIRED TO HAVE A COMPUTER, WEBCAM AND MICROPHONE. IT IS THE STUDENT'S RESPONSIBILITY TO HAVE THE REQUIRED EQUIPMENT TO PARTICIPATE AND RECEIVE CREDIT. Virtual Classroom Guidelines: Students must have a computer, webcam and microphone capability to participate and receive continuing education credit. If you have a Lenovo laptop, you must have the Lenovo Vantage App installed on your computer for the webcam to operate. The platform will be interactive and live. The instructor must be able to physically see and interact with all students and students must be able to see and interact with the instructor. A copy of your driver's license must be emailed to the Chapter office as verification after you have registered for the offering prior to the start date. You will receive a separate email from the chapter office with log-in access information.
